HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CRIMINAL PETITION NO. 1535 OF 2015 ORDER:
On hearing learned counsel for petitioners at the admission stage, the following order is passed. Having regard to the fact that there is a prima facie accusation in the FIR and investigation is said to be under way, it is not a fit case to quash the proceedings. However, having regard to the submission of learned counsel for the petitioners/A-1 & A-2 to the effect that the de-facto complainant has not honoured the terms of the agreement to sale and not paid the balance amount and on the other hand lodged a false report against them and they have submitted a report to Superintendent of Police, Karimnagar on 8.10.2014 mentioning all these facts but no action so far has been taken in this regard, the Police of Ibrahimpatnam Police Station, Karimnagar District, are directed not to arrest petitioners/A1 & A2 during the course of investigation.
Petitioners/A1 &A2 shall cooperate with the investigating agency for smooth completion of investigation.
Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
