C. Ramana Kumar, W/o K. Krishna Murthy, Aged about 54 years, Senior Superintendent, XV Additional Chief Metropolitan Magistrate Court, Hyderabad ... Petitioner Vs.
Metropolitan Sessions Judge, Criminal Courts Complex, Nampally, Hyderabad.
..... Respondent For Petitioner : Mr. P. Ravi Shanker, For Respondents : Mr. Abhinand Kumar Shavali
VRS, J & TR, J W.P.No.26796 of 2017 HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE MRS. JUSTICE T. RAJANI Writ Petition No.26796 of 2017 ORDER: (V. Ramasubramanian, J) The petitioner has come up with the above writ petition challenging a charge memo issued by the respondent Metropolitan Sessions Judge, Nampally.
2. Heard Mr. P. Ravishanker, learned counsel for the petitioner.
3. A charge memo can be challenged only on very very limited grounds. It can be challenged on the ground that the charges relate to an event on which a disciplinary proceedings was already initiated and concluded. Alternatively, a charge memo can be challenged on the ground of lack of authority on the part of the officer, who initiates the disciplinary proceedings.
4. Though the list is not exhaustive, the challenge by the petitioner to the charge memo in this case, does not fall in any one of the categories on which a charge memo can be challenged.
5. The complaint of the petitioner is that the Presiding Officer already held her not guilty. But the same does not prevent the Disciplinary Authority from going in detail. What the Presiding Officer says is not final, when the conduct of an officer is made subject to scrutiny in a departmental proceedings. Therefore, we find no reasons to entertain the writ petition.
VRS, J & TR, J W.P.No.26796 of 2017 Accordingly, the writ petition is dismissed.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
