THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38306 of 2016 ORDER:

This writ petition is filed seeking to declare the action of respondents 3 & 4 in calling and threatening the petitioners to vacate the house bearing H.No.8-7-171/56/71, Mythrivan Colony, Old Bowenpally, Balanagar Mandal, Kukatpally, Ranga Reddy District, as illegal and arbitrary.

Heard and perused the material available on record. The case of the petitioner is that the 1st petitioner is the absolute owner and possessor of the house bearing H.No.8-7171/56/71, Mythrivan Colony, Old Bowenpally, Balanagar Mandal, Kukatpally, Ranga Reddy District and that the 1st petitioner had filed a suit in O.S.No.1765 of 2015 before the VII Additional Senior Civil Judge, Ranga Reddy District, at L.B. Nagar, seeking interim injunction against the defendants therein. The 4th respondent has been visiting the house of the petitioners and threatening the petitioners with dire consequences to withdraw the said suit with immediate effect and threatened to vacate the premises by 07.11.2016 otherwise he would book false cases against the petitioners.

Considering the grievance of the petitioners, the 4th respondent is directed not to interfere with the affairs of the petitioners and the defendants in O.S.No.1765 of 2015, more particularly, with the civil disputes pending between them. However, this order will not stand in the way of the 4th respondent to register a case, if any complaint is lodged against the petitioners for cognizable offence.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 8th November, 2016 KL
