HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.6620 of 2019 ORDER:

This Writ Petition is being disposed of at the admission stage with the consent of both the counsel.

The petitioner is challenging the action of respondents in disqualifying the petitioner on the ground that the petitioner's chest expansion is 2 cms. He contended that the respondents have improperly taken the measurements and disqualified him. 3.

Learned counsel for the petitioner contends that when a similar issue fell for consideration before this Court in W.P.No.6233 of 2019, dated 26-03-2019, this Court was pleased to dispose of the said Writ Petition directing the respondents to re-measure the chest expansion of the petitioner in accordance with rules. He further contends that similar order may be passed in this Writ Petition also directing the respondents to reconsider the case of the petitioner for re-examination of the chest expansion of the petitioner and later, if the petitioner is qualified, then allow him to participate in further selection process.

Learned Standing Counsel has also not disputed about the said fact.

This Court, having considered the rival submissions made by both the parties, is of the considered view that the Writ Petition can be disposed of directing the respondents to consider the

AKS,J W.P.No.6620 of 2019 case of thee petitioner for the re-examination of the chest expansion measurements in accordance with the orders passed in the W.P.No.6233 of 2019, dated 26-03-2019 and pass appropriate orders. 6.

With the above observations, the writ petition is disposed of. No order as to costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
