HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.5523, 5546 & 5547 of 2018 COMMON ORDER:

Heard learned counsel for the respective petitioners, learned Government Pleader for Municipal Administration for respondent No.1 and Sri M. Balaji, learned Standing Counsel for respondent Nos.2 & 3 from the oral instructions and perused the respective prayers in the writ petitions with the supporting affidavits and other material on record.

It is the grievance of the petitioners that under the guise of part of the construction of the petitioners is as if in the Government land or road encroachment, the respondents are choosing to take the law into their hands though there is no encroachment by the petitioners.

It is the submission of the learned Standing Counsel vis-àvis learned Government Pleader that they are following due process of law.

Having regard to the above and by recording the same, the Writ Petitions are disposed of with a direction to the respondents without following due process of law demolition cannot be undertaken.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
