THE HON'BLE SRI JUSTI CE M.S.K. JAI SWAL WRI T PETI TI ON No.26117 of 2008 ORDER:

This writ petition is filed for a mandamus, declaring the inaction of the 3rd respondent in passing the clarification orders with regard to the co-relation of old survey numbers with the new survey numbers on the representation of the petitioner, dated 05.05.2008, as illegal and arbitrary, and consequently declare the proceedings No.A4/61/2006-2Gen, dated 03.01.2006 issued by the 1st respondent as null and void on the ground that it has been issued on the old survey numbers.

The petitioner claims that the lands that are prohibited are in Sy.No.178, which is a new survey number, but not the old survey number, which has been re-numbered in 1960 as Sy.Nos.101/1, 2 & 3. Since the 4th respondent addressed the 5th respondent not to register the lands in Sy.No.178, the authorities are not entertaining the registration of lands in Sy.Nos.101/1, 2 & 3 on the ground that Sy.No.178 corresponds to Sy.No.101/1, 2 & 3. Therefore, the petitioner made a representation to the 3rd respondent on 05.05.2008 seeking a clarification on this aspect and the same is pending with him without passing any orders thereon.

In that view of the matter, the Writ Petition is disposed of, directing the 3rd respondent to consider and pass appropriate orders on the representation of the petitioner, dated 05.05.2008, in accordance with law, if it is still pending, within a period of 4 (four) weeks from the date of receipt of a copy of this order. Pending miscellaneous applications, if any, shall stand closed in consequence.
