HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.29 of 2015 ORDER:

This petition is filed to withdraw O.P.No.124 of 2012 from the file of Senior Civil Judge, Tadepalligudem, West Godavari District, and transfer the same to Family Court, East Godavari, at Rajahmundry.

2. Wife filed this petition contending that her marriage was performed with respondent on 22.03.2003 at Annavaram and due to differences she is living separately. She contended that she filed M.C. before Family Court, Rajahmundry, and the same is pending and respondent filed O.P.No.124 of 2012 before Tadepalligudem and to avoid conflicting decisions both the cases have to be tried by one Court. She further contended that it is difficult for her to travel from Rajahmundry to Tadepalligudem to defend O.P. filed by respondent.

3. Other side advocate reported no objection for transfer of O.P. from Tadepalligudem to Rajahmundry.

4. Considering the submissions of both sides and considering the convenience of wife and also considering that M.C. filed by wife is pending before Family Court, Rajahmundry, O.P.No.124 of 2014 is withdrawn from the file of Senior Civil Judge's Court, Tadepalligudem, West Godagvari District, and transferred to Family Court, East Godavari at Rajahmundry, for disposal in accordance with law.

5. Accordingly, the transfer C.M.P. is ordered. No costs.
