THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO Crl.A.No.856 of 2005 JUDGMENT :

None appears for petitioner.

2. The learned Public Prosecutor has placed before me letter No.CPCh/RC-1/13964/2008 dt.11.12.2008 issued by the Superintendent, Central Prison, Cherlapalli to the effect that the appellant was released from the said prison after serving the sentence imposed on him by the court below after earning a remission of (348) days under the Remission Rules. The said letter has been placed on record.

3. Having regard to the contents of the said letter, it is clear that petitioner has served the sentence imposed on him in S.C.No.395 of 2004. Therefore, the appeal has b e c o m e infructuous.

Hence, it is dismissed as infructuous.

Miscellaneous petitions, pending if any, in this Appeal, shall stand closed.
