THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.43003 of 2016 ORDER:

Heard Sri V.R.Reddy Kovvuri for petitioners and Assistant Government Pleader (Revenue).

The Assistant Government Pleader (Revenue) places on record the written instructions dated 13-12-2016. The relevant portion of the written instructions reads thus:- " ..... The District Collector after carefully examining the petitions of the writ petitioners and other persons, passed orders vide proceedings number G1/ 4814/ 2010 dated 21-10-2014. The orders of the District Collector have been served on all the objectors including the present 18 writ petitioners. After approval of the market value proposals, notices under Section 9(1) and 10 and 9(3) 10 were issued to all the land owners to appear before the Land Acquisition Officer, and Revenue Divisional Officer, Kadapa, on 19-12-2014. Out of 51 persons only 7 persons have filed their documents in support of their title over the lands and accordingly General Award passed vide Award No.11/ 2016-17 dated 19-11-2016 by the District Collector, Y.S.R.District, kadapa under Sections 26 to 30 of the New RFC & T in LA, R&R Act, 2013 for an extent of 2,656 square feet's out of 18,505 square feet's leaving a balance of 15,849 square feet's.

The contention of the writ petitioner that there is no necessity for construction of Railway Over Bridge across the railway line as on " Under Ground Bridge" constructed very near to the L.C. gate is not correct."

Since the prayer proceeds on the assumption that no Award is made and the written instructions refer to passing of Award on 19-11-2016, Sri V.R.Reddy Kovvuri requests the court to direct the respondents to communicate the copy of Award to petitioners forthwith and petitioners may be given liberty to assail the Award. The respondents are directed to communicate the copy of Award to petitioners within one week from today and the petitioners, if so advised, can work out the legal remedies against the Award in accordance with law.

With the above observation, the writ petition is disposed of accordingly. No order as to costs.
