THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.5490 of 2018 ORDER:
The petitioner prays for the following relief: ".............writ of mandamus declaring the inaction on the part of the 3rd respondent in considering the representation dated 06.02.2018 submitted by the 1st petitioner company, as illegal, arbitrary and violative of Article 14, 19 (1) (g) and 21 of the Constitution of India and consequently direct the 3rd respondent herein to consider the representation dated 06.02.2018 submitted by the 1st petitioner company and pass appropriate orders thereon............"
The Court has difficulty in appreciating the substantive prayer made by the petitioners. But what is evident from the record is that the petitioners, out of six
(06) installments granted by the respondents did comply with the 1st installment and due to delay in receiving the payments could not honour the 2nd installment on 06.02.2018. The representation is made to respondent No.3. In the fitness of things, the 3rd respondent ought to have taken a decision expeditiously, if necessary, by putting further terms and conditions on the petitioners. The inaction certainly leads to uncertainty. Hence, the writ petition is disposed of by this order:
The 3rd respondent is directed to consider and pass orders on the request of the petitioner dated 06.02.2018 within one (01) week from the date of receipt of copy of this order. The petitioners are given liberty to submit a copy of this order together with the representation dated 06.02.2018 for expeditious disposal. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
