HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3520 OF 2017 ORDER:

This writ petition is filed challenging the resumption orders dated 24-04-2016 in Roc.No.383-II/2015(A)-120, 383-II/2015(A)-124 mainly on the ground that though the petitioner filed explanation in pursuance to the show-cause notice issued on 01-10-2015 and received by the respondents on 16-10-2015. Without considering the same, the impugned orders are passed stating that the petitioner has not submitted any explanation.

Heard both sides.

Without going into the merits of the case, only on the ground of principles of natural justice that the explanation of the petitioner was not considered and passed the impugned orders, this writ petition is allowed setting aside the impugned orders. Since it is stated that the petitioner has already filed explanation, it is open for the petitioner to file copies of said explanation before the 4th respondent in person within a period of two weeks from today and on such submission of explanation, the 4th respondent shall consider the same and pass final orders after giving opportunity to the petitioner as well as affected parties if any. Till such time, there shall be status-quo obtaining as on today.
