HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20049 of 2017 ORDER:

This writ petition is filed challenging the action of the respondents in interfering with the possession of the petitioner over his shop-cum-house bearing D.No.3-138 consisting of Ground and First floors, situated at Meda Street, Kalyandurgam, Ananthapuram District, without following due process of law.

It is the case of the petitioner that on 10.6.2017, the officials from the office of the 3rd respondent came to his house/shop and started taking some measurements without any intimation, and when the petitioner questioned them, they informed that the subject house/shop is required for widening of the road. Further, the said officials directed the petitioner to vacate the premises within two weeks. Hence, the petitioner filed this writ petition.

Heard and perused the material available on record. 4.

The main grievance of the petitioner is that the respondents are trying to dispossess him and demolish the said house/shop, without following the due process of law.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the Writ Petition is disposed of directing the respondents to follow the due process of law, if they intend to acquire the subject house/shop of the petitioner. No costs. Pending miscellaneous petitions, if any, shall stand closed.
