HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.6668 OF 2019 ORDER:

Petitioners claim to be the partners of M/s. S.M.Enterprises Shabeer Mohsin. Petitioners claim to have made representation on 27.02.2019 to the Inspector of Police, Chandrayangutta Police Station requesting to grant permission to make lucky draws on every Sunday i.e., weekly basis, in R.K. Function Hall, Bandlaguda, Hyderabad and requested permission for conducting such draws. 2.

Affidavit filed in support of the Writ Petition is silent on the nature of business activity of petitioners - M/s. M.S. Enterprises and for what purpose, they intend to conduct lucky draws on every Sunday. A vague representation is made, and alleging that no decision is made on the said representation, this Writ Petition is filed. 3.

It is further seen from the representation (Ex.P1), though representation was dated 27.02.2019, it was actually sent by Registered Post on 07.03.2019, and within few days this Writ Petition is filed. Affidavit as well as representation dated 27.02.2019, lacks essential details on what basis and for what purpose the lucky draws are to be held, and no legal right is made out on their entitlement to seek such permission to conduct lucky draws, in order to hold the action of respondents in not considering the said request as illegal. Further, when such representation was sent only on 07.03.2019, it cannot be said that there is inordinate delay in considering such request, warranting interference by this Court. Writ Petition is accordingly dismissed. Pending miscellaneous petitions shall stand closed.
