THE HON'BLE SRI JUSTICE K.C.BHANU WRIT PETITION No.14356 of 2015 ORDER:

The relief sought for in this writ petition is to declare the action of the 3rd respondent in not registering the complaint of the petitionersociety against the 4th respondent as illegal and arbitrary. Learned counsel for the petitioner contended that in spite of giving complaint, which discloses commission of cognizable offence, police have not registered any case against the 4th respondent and the higher officials also did not take any action. In case the Station House Officer concerned or the higher officials did not take action on the complaint, which discloses commission of cognizable offence, the remedy of the petitioner is otherwise. The petitioner can file a complaint either under Section 190 or 200 of the Code of Criminal Procedure, 1973 (Cr.P.C) before the Magistrate concerned.

Therefore, the writ petition is disposed of, giving liberty to the petitioner to avail the remedies available to it under law, particularly under the provisions of the Cr. P.C. Miscellaneous petitions pending, if any, in the writ petition shall stand closed. There shall be no order as to costs.
