THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.2053 OF 2018 ORDER:
This petition is filed under Section 482 of the Code of Criminal Procedure by the petitioner/A.10 seeking to quash the proceedings against him in Crime No.60 of 2018 of Tadipatri Town Police Station, Ananthapuramu District, registered for the offences under Sections 420, 406, 120-B read with Section 34 IPC and Sections 3 and 4 of the A.P.Gaming (Matka) Act. Learned Additional Public Prosecutor would submit that the investigation is in the nascent stage and only two witnesses are examined so far. In view of it, this Court is not inclined to quash the proceedings. The investigation shall be continued to its logical end. However, having regard to the nature of the offences involved, i.e., Sections 420, 406, 120-B read with Section 34 IPC and Sections 3 and 4 of the A.P.
Gaming (Matka) Act, the investigating officer shall strictly follow the guidelines given by the Hon'ble Apex Court in Arnesh Kumar v State of Bihar1 and also follow the provisions contained in Section 41-A CrPC during the course of investigation towards the petitioner/A.10. The petitioner/A.10, in turn, shall cooperate with the investigating officer for smooth completion of the investigation. The criminal petition is accordingly disposed of.
