HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION Nos.21996 and 22135 of 2017 COMMON ORDER:

These Writ Petitions are filed under Article 226 of the Constitution of India, seeking the following reliefs: W.P.No.21996 of 2017:

" .....to issue an appropriate writ or direction, more particularly a Writ in the nature of Mandamus declaring the action of the respondents in showing the name of the deceased Rayavarapu Seethamma as beneficiary in the statement of details of assignment formulated under Rehabilitation Scheme of LMC Project as illegal, arbitrary and un-constitutional and consequently direct the respondents to forthwith remove the name of Late Rayavarapu Seethamma under beneficiary list and modify the same with the name of the petitioner in respect of the property to an extent of Ac.0.03 cents or 144 Sq.yards of land consisting of tiled house bearing Panchayat Assessment No.214 of Kummarilova village, Tuni Mandal, East Godavari District which is covered by Plot No.118 in Survey No.69/ 1 as required under land acquisition and be pleased to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

W.P.No.22135 of 2017:

" .....to issue an appropriate writ or direction, more particularly a Writ in the nature of Mandamus declaring the action of the respondents in showing the name of the deceased T.Mutyalamma as beneficiary in the statement of details of assignment formulated under Rehabilitation Scheme of LMC Project as illegal, arbitrary and un-constitutional and consequently direct the respondents to forthwith remove the name of Late T.Mutyalamma under beneficiary list and modify the same with the name of the petitioner in respect of the property to an extent of Ac.0.03 cents or 144 Sq.yards of land consisting of tiled house bearing Panchayat Assessment No.213 of Kummarilova village, Tuni Mandal, East Godavari District which is covered by Plot No.118 in Survey No.

69/ 1 as required under land acquisition and be pleased to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case." Heard learned counsel for the petitioner and also learned Government Pleader for Land Acquisition appearing for respondents and perused the prayers in the writ petitions with supporting affidavits and other material on record.

to mention if at all the petitioner's mother-in-law and mother are no more and the subject properties belong to her husband and father respectively, by showing who are their legal heirs. Having regard to the above and from the submissions, both the writ petitions are disposed of permitting the petitioner in the respective writ petitions to submit a representation with documentary proof to the 2nd respondent within a period of one week from the date of receipt of copy of this order and the 2nd respondent shall pass a detailed order within a period of four weeks thereafter and communicate the same as regards the entitlement of compensation by the petitioner including her daughter, who is mentally challenged, represented by her as guardian.

With the above directions and observations, the Writ Petitions are disposed of.
