HON'BLE SRI JUSTICE A.V.SESHA SAI Writ Petition No.19127 of 2013 ORDER:- The grievance of the petitioner in the present Writ Petition is the alleged inaction on the part of the respondents No.1 to 7 in taking action against the respondents No.8 and 9, who are allegedly making constructions of Masjid and Madarsa in the petitioner's house site.

A counter affidavit, deposed by the Commissioner, Municipal Corporation, Vijayawada, is filed. Paragraph No.5 of the said counter reads as under:- "In reply to para-8, it is submitted that the issue is not in the purview of the Corporation as it is purely civil dispute. It is submitted that the Corporation issued notice, dated 08.10.2013, to the concerned respondents directing them to stop further construction and if any such construction takes place, the same shall be demolished. The respondent Corporation will take action according to the provisions of the GHMC Act."

Having regard to the contents of the above said paragraph of the counter, this Writ Petition is disposed of, by placing on record the contents of paragraph No.5 of the counter. As sequel to it, Miscellaneous Petitions, if any pending, shall stand dismissed. No order as to costs.
