P. Praveen Raj v. The State Of Telangana,
THE HON'BLE SRI JUSTICE K.C. BHANU AND THE HON'BLE MRS JUSTICE ANIS WRIT APPEAL No.466 OF 2015 JUDGMENT: (per Hon'ble Sri Justice K.C.Bhanu) This Writ Appeal is filed aggrieved by the order, dated 30.3.2015, in Writ Petition No.8494 of 2015 of a learned Single Judge of this Court.
2. W.P.No.8494 of 2015 was filed by the appellant herein/writ petitioner seeking to issue a writ of Mandamus declaring the action of respondent No.5 in issuing letter vide Lr.No.3/106/2014-2, dated 17.3.2015, to respondent No.7 for furnishing the movable and immovable properties of the writ petitioner as illegal and arbitrary, and consequently, to set aside the same and reinstate the writ petitioner back into service with all consequential benefits. The writ petition was dismissed at the stage of admission by the learned Single Judge holding that no harm or prejudice would be caused to the writ petitioner if the respondents ascertain all his movable and immovable assets.
3. Heard both sides.
4. The allegation against the appellant/writ petitioner is that while he was working as a Technical Assistant employed with the National Rural Employment Guarantee Scheme (N.R.E.G.S.), he committed misappropriation of Rs.18,81,000/- of N.R.E.G.S. funds. The letter, dated 17.3.2015, is only a direction to the Mandal Parishad Development Officer to furnish the movable/immovable property particulars of the appellant and his family members. Hence, the learned Single Judge rightly dismissed the Writ Petition and that order needs no interference of this Court, as there is no illegality in passing
that order. The Writ Appeal is devoid of merit and is liable to be dismissed.
5. The Writ Appeal is, accordingly, dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Appeal shall stand closed.
