THE HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.426 of 2016 ORDER:

This application is filed to withdraw H.M.O.P.No.10 of 2016 from the Court of Senior Civil Judge, Amalapuram, East Godavari District, and transfer the same to the Family Court at Hyderabad or Secunderabad.

2. Wife filed this application. According to her affidavit, her marriage with respondent was performed on 15.08.2014 at Hyderabad as per Hindu rites and caste custom, and due to threat from respondent and his family members, she was forced to leave marital home. She stated that she is now staying with her younger brother at Hyderabad since 2015 and it is difficult for her to appear before the Court at Amalapuram, East Godavari District to defend H.M.O.P.No.10 of 2016. She stated that she has to travel alone from Hyderabad to Amalapuram and that she has life threat at Amalapuram. She further stated that she has already filed M.C.No.164 of 2016 before Family Court - cum - Metropolitan Sessions Judge for trial of Jubilee Hills Car Bomb Blast Case - cum - XXIII Additional Chief Judge, Nampally, Hyderabad seeking maintenance. For these reasons, she prayed for transfer of H.M.O.P.No.10 of 2016 from the Court of Senior Civil Judge, Amalapuram, East Godavari District, to the Family Court at Hyderabad or Secunderabad.

This Court permitted petitioner to take out personal notice on respondent through Registered Post with Acknowledgement Due and in compliance of the said order, advocate for petitioner filed a memo dated 26.07.2016 stating that notice is duly served on respondent and filed postal acknowledgement along with memo. In spite of service of notice, respondent neither appeared in person nor through any advocate.

4. Heard arguments of advocate for petitioner.

Considering the reasons stated in the affidavit filed in support of this petition and also considering the convenience of wife, H.M.O.P.No.10 of 2016 is withdrawn from the Court of Senior Civil Judge, Amalapuram, East Godavari District, and transferred to Family Court - cum - Metropolitan Sessions Judge for trial of Jubilee Hills Car Bomb Blast Case - cum - XXIII Additional Chief Judge, Nampally, Hyderabad, for disposal in accordance with law.

6. The petition is ordered accordingly. No costs. Miscellaneous petitions, if any, pending in this petition, shall stand dismissed. ___________________ S. RAVI KUMAR, J 10th August, 2016.
