This writ petition is filed challenging the action of the third respondent in not considering the application of the petitioner dated 23.08.2017 for mutation of his name in the revenue records in respect of the land of an extent of Ac.1-48 cents in D.No.235/4 of Bhimavaram village, Sattenapalli Mandal, Guntur District, pursuant to a Will Deed dated 16.08.2016.

After adjourning the matter by two weeks, learned Government Pleader obtained written instructions. As per the written instructions, it is stated that the petitioner filed a claim under the Andhra Pradesh Dotted Lands (Updation in Resettlement Register) Rules, 2017, but he has not applied for mutation of his name. It is also stated that the land in Survey No.235/4 is classified as Vagu Poramboke as per RSR and it is a water course. Since the name of the petitioner cannot be entered in the revenue records, his application was rejected. It is also stated that the petitioner is not an original assignee and he got transfer of the land violating the conditions of assignment in Form-D. In view of the above written instructions, it is open to the petitioner to take appropriate legal remedies in accordance with law, but no relief can be granted in the present Writ Petition.

The Writ Petition is, accordingly, dismissed. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________________ A.RAMALI NGESWARA RAO, J Date: 07.03.2018 Nsr
