This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by the petitioner/Accused No.7 seeking anticipatory bail in connection with Crime No.667 of 2025 of Saroornagar Police Station, Rachakonda. The offences alleged against the petitioner are under Sections 189 (2), 191(2), 333 and 109 of Bharatiya Nyaya Sanhita, 2023.

The facts of the case are that the de-facto complainant lodged a complaint before police on 23.06.2025 stating that he runs a pushcart fruit business and on 22.06.2025, after finishing his daily work, he returned to his home and went to sleep and in the midnight some un-known persons came to his
home and started abusing them in filthy language, asking for a person named 'Bhadru'
and demanding to know his whereabouts. Along with the said persons, Bhadru's elder brother Veeresh was also present. Though the defacto complainant repeatedly informed them that they did not know the whereabouts of Bhadru, accused persons did not hear him and physically assaulted him with their hands. Upon hearing the commotion, neighbours came there and rescued them and he revealed the names of A-1 to A-3 and 2 others. Hence, he requested the police for taking necessary action, basing on the same, Police registered the case against the accused for the above offences.

Heard Sri Kasireddy Mohan Chandra Has, learned counsel for the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State. 4.
The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations. He further submitted that even according to the eye-witnesses they have not mentioned the name of the petitioner herein. He further submitted that the crime was registered in the year 2025, investigation is already completed and supplementary charge sheet is filed and as A-1 to A-6 were already enlarged on bail,
the custodial interrogation of petitioner/A-7 is not required. Hence, he prayed this Court to grant anticipatory bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the alleged offence against the petitioner is Section 109 of BNS, which is grievous in nature. He further submitted that petitioner is absconding from the date of registration of the case, as such, for other accused charge is already filed. Therefore, the petitioner is not entitled for anticipatory bail and requested this Court to dismiss the petition.

Considering the submissions made by both the parties and the material on record, there are no specific allegations against the petitioner herein as per the statements of witnesses under Section 161 of Cr.P.C. In that view of the matter, this Court deems it fit to grant anticipatory bail to the petitioner subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Saroornagar Police Station, Rachakonda within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for the like sum each.
ii. The petitioner shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation or till filing of charge sheet whichever is earlier and thereafter, as and when required.
iii. The petitioner shall abide by the other conditions stipulated in Section 482 (2) of BNSS and cooperate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
