THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION NO.41339 of 2015 O R D E R: (per Hon'ble Sri Justice Sanjay Kumar) Challenge in this writ petition is to the refusal by the Andhra Pradesh Administrative Tribunal, Hyderabad, to grant interim relief in O.A.No.6607 of 2015. The subject matter of the said O.A was with regard to the allocation of the petitioner to the State of Andhra Pradesh consequent to the bifurcation of the erstwhile State of Andhra Pradesh into the State of Telangana and the State of Andhra Pradesh.
By order dated 15.12.2015 passed in the O.A, the Tribunal while admitting the O.A and ordering notice to the respondents directed that final allocation of the petitioner/applicant to the State of Andhra Pradesh shall be subject to the final result in the O.A.
Though Sri P.V. Ramana, learned counsel for the petitioner, would contend that the issue requires to be addressed immediately as the petitioner is already aged about 55 years and that the Tribunal ought to have considered the matter at the interlocutory stage, we are of the opinion that a matter of this nature would be required to be heard finally and no exception can be taken to the direction of the Tribunal making the allocation of the petitioner to the State of Andhra Pradesh subject to the final result in the O.A. However, as rightly pointed out by Sri P.V. Ramana, learned counsel, the petitioner is already aged 55 years and would be retiring from service in few years.
That being so, the Tribunal shall endeavour to dispose of the O.A expeditiously after completion of the pleadings. Subject to the above observation, the Writ Petition is dismissed. Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
