O R D E R
The petitioner herein claims that she and her deceased husband were assigned certain extents of land in Paradesipalem, Visakhapatnam Rural Mandal, in the years 1960 and 1961. She further claims that the said land has been in her possession ever since and that she brought the same under cultivation. While so, she alleged that the respondents threatened to dispossess her from the said land without taking recourse to the procedure laid down by law and accordingly approached this Court by way of the present writ petition seeking to protect her possession.
By order dated 15.04.2005, this Court directed the respondents not to dispossess the petitioner from the subject land. The said order was made absolute on 16.06.2008.
Though nearly ten years have elapsed since the institution of the writ petition, no counter-affidavit has been filed by any of the respondents. However, as the matter falls within a short compass, it is amenable to disposal at this stage even in the absence of the respondents' response.
The petitioner lays claim to possession over the subject land under assignments dating back to 1960 and 1961. There is no rebuttal of this averment. In that view of the matter, the respondents shall not dispossess the petitioner or in any manner interfere with her possession over the subject land except in accordance with the due procedure laid
down by law.
The writ petition is disposed of with the above direction. Pending Miscellaneous Petitions, if any, shall stand closed. No order as to costs. ------------------------------------- SANJAY KUMAR, J 28th JANUARY, 2015 PGS
