HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.18736 of 2017 ORDER:

Heard Sri V.V.L.N. Sarma, for petitioners and the learned Assistant Government Pleader (Revenue) for respondents 1 to 6.

2. The petitioners while complaining against inaction of respondents 2 and 3 in considering and disposing of the representation dated 17.10.2016, tried to contend illegalities and irregularities allegedly committed by the Tahsildar/ 5th respondent by issuing pattadar pass books in favour of respondents 7 to 9.

3. Learned counsel made several submissions on the alleged illegalities committed by the Tahsildar/ 5th respondent. His further grievance is that the District Collector/ 2nd respondent has called for report from the Tahsildar. The report is made available with Recording Authority, still the Joint Collector is not moving in the matter.

4. From the totality of circumstances either argued or narrated in the affidavit, this court is of the view if at all the Recording Authority contrary to the conclusion recorded by the Joint Collector, through order dated 11.08.2015, has acted in the matter, the petitioners have to workout the comprehensive remedy under Section 9 of the A.P. Rights in Land and Pattadar Passbooks Act, 1971. Mr.V.V.L.N.Sarma seeks leave of the court to file revision against either commission or omission of Tahsildar in recording, maintaining or continuing record of right or issuing pattadar pass books to any person. Liberty is granted. The revision can be filed by enclosing a copy of this order and the Revisional Authority is directed to take up the case and dispose of the revision, in

accordance with law, after notice to contesting parties, expeditiously, preferably within two months from the date of submission of the revision.

5. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
