SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2041 OF 2018 ORDER:

This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioners, who are A1 and A2, on bail in SC.NDPS/200236/2017, on the file of I Additional District and Sessions Judge, Rajahmundry, East Godavari District, registered for the offences punishable under Sections 8(c) r/w Section 20(b)(ii) of NDPS Act.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

As per the case of the prosecution, 125 Kgs of Ganza was being dealt with by the accused. The counsel for the petitioners submits that A3 and A4 are the purchasers of Ganza who handed over it to these petitioners, who are accused 1 and 2. It appears that these petitioners are also involved in this business of Ganza sale, along with A3 and A4. Moreover, the earlier petition filed by these petitioners, was dismissed by this Court, by considering the merits of the case.

Hence, in the above circumstances, this Court is not inclined to grant bail by violating the mandate of Section 37 of NDPS Act.

Accordingly, this criminal petition is dismissed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
