HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION NO.9716 OF 2011 ORDER:

The petitioner's complaint in this Writ Petition is that the respondents had highhandedly seized four big oil containers, one weighing machine, eight small oil containers and one counter, and a small almyrah in which she had kept an amount of Rs.11,880/-; and they had asked her how she was running a coconut oil machine in her residence.

The petitioner claims that she is not running any business as she lost her trade license in the previous year. She claims to have applied for a trade license by paying a fee in E-seva on 16.12.2011, and complains of the respondents threatening to take away all her belongings without issuing her a trade license. In case the petitioner is carrying on business of running a coconut oil machine in her residence, she would, undoubtedly, require a trade license to do so.

As the petitioner claims to have made an application for grant of trade license, suffice it if the Writ Petition is disposed of directing the GHMC to consider the application, for grant of trade license, in accordance with law. Needless to state that, in case the petitioner is held not entitled for grant of trade license, it is open to the respondents to take action against her, for carrying on her business without a trade license, in accordance with law. The Writ Petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed.
