THE HON'BLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No.3044 of 2025 ORDER:

This criminal petition is filed by the petitioner/A1 under Sections 480 and 483 of Bharatiya Nagrik Suraksha Sanhita (BNSS) to enlarge her on bail in Crime No215 of 2025 of Jeedimetla Police Station, Medchal-Malkajgiri District, for the offence punishable under Sections 143 and 144 BNS and Sections 3, 4 and 5 of the Immoral Traffic Prevention Act (PITA). 2.

Heard Sri M. Keshav Yadav, learned counsel for the petitioner, and learned Additional Public Prosecutor for the respondent.

The case of the prosecution is that the Sub-Inspector of police, Jeedimetla Police Station, on receipt of credible information that the petitioner/A1 is running brothel house in a rented portion in 1st Floor in H.No.48-506/1, Ganeshnagar Chinthal by engaging sex workers, he made GD entry and after obtaining permission from ACP, Balanagar to conduct raid, at about 1725 hours he along with the mediators, patrol mobile staff, women police constable reached the said address and

found two female persons and one male person in the hall and on enquiry, the sex worker disclosed her name as Kairamkonda Navya and all the said persons were brought to the police station and thereafter registered a case in Crime No.215 of 2025 for the aforesaid sections and remanded them to judicial custody on 14.02.2025.

Learned counsel for the petitioner submits that the petitioner has not committed the alleged offence and she was falsely implicated in the above said crime. He further submits that the petitioner was arrested on 14.02.2025 and since then she is in judicial custody. He further submits that the petitioner is a widow and is suffering with health problems and the entire investigation is completed and the petitioner is ready to abide by the conditions that are going to be imposed by this Court. He further submits that Accused Nos.2 and 3 have already enlarged on bail.

Per contra, learned Additional Public Prosecutor submits that against Accused Nos.2 and 3 notices under Section 35(3) BNSS were served on 14.02.2025. It is not disputed that the

petitioner is not an accused in any other case and after completion of investigation, charge sheet will be filed. 6.

Having considered the rival submissions made by both the parties and after perusal of the material available on record, it reveals that the petitioner is aged about 61 years and she is a widow and that the learned Additional Public Prosecutor has not disputed that other accused Nos.2 and 3 were released on bail. 7.

Taking into consideration the facts and circumstances of the case and that the petitioner was in judicial custody since 14.02.2025, this Court is inclined to grant bail to the petitioner on the following conditions:

(1) The petitioner/A1 is enlarged on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousands only) with two sureties for a like sum each to the satisfaction of the VIII Additional Metropolitan magistrate, Cyberabad at Medchal.

(2) The petitioner shall appear before the concerned SHO at 11:00 A.M. on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation and thereafter as and when required.

(3) The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the criminal petition is allowed. Pending miscellaneous applications, if any, shall stand closed.
