HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND HON'BLE SRI JUSTICE M.S.K.JAISWAL WRIT PETITION No.6279 of 2016 Date:26.02.2016 Between:

C.Ravindra Prasad, S/o C.Bhaskaraiah ....Petitioner And:

Union of India, reptd by its Secretary, Ministry of Defence, New Delhi and five others.

.....Respondents Counsel for the petitioner: Mr. D.Rama Krishna Counsel for the Respondents: Mr. B.Appa Rao representing Mr. B.Narayana Reddy Assistant Solicitor General The Court made the following:

ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) Feeling aggrieved by dismissal of O.A.No.1210 of 2014 by the Central Administrative Tribunal, Hyderabad Bench, Hyderabad (for short 'the Tribunal'), by its order,

dated 09.02.2016, the applicant therein filed the present Writ Petition.

From the admitted facts of the case, it is evident that on the strength of an interim order granted by the Tribunal staying the transfer of the petitioner, on the ground of illness of his wife, he had the benefit of working in Hyderabad despite his transfer to Jodhpur more than 1 1⁄2 years ago.

Observing the reluctance of this Court to interfere with the impugned order of the Tribunal, Mr. D.Rama Krishna, learned counsel for the petitioner, fairly submitted that his client will be satisfied if he is granted three weeks' time to report to duty at Jodhpur, the place to which he was transferred.

Mr. D.Appa Rao, learned counsel, representing Mr. B.Narayana Reddy, learned Assistant Solicitor General, appearing for the respondents, has fairly not opposed this request.

In the light of the above facts, we dismiss the Writ Petition, however, by granting three weeks' time from today to the petitioner to join at the transferred place. As a sequel to dismissal of the Writ Petition, WPMP.No.7988 of 2016 filed by the petitioner for interim relief is dismissed as infructuous.
