THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.14760 of 2014 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioners-A.1 to A.4 in Cr.No.134 of 2014 of Police Station, N.T.P.C., registered for the offences punishable under Sections 498-A of I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, praying to quash the proceedings in said crime.

2. Heard the learned counsel for the petitioners/A.1 to A.4 so also the learned Public Prosecutor representing State-2nd respondent before ordering notice to the 1st respondent/de facto-complainant and perused the material on record.

3. As the material falls short for this Court to admit the application under Section 482 of Cr.P.C. and also to stay investigation, but for their entitlement to concession of bail, this Criminal Petition is disposed of giving liberty to the petitioners to surrender before the learned Magistrate and move an application for regular bail, with a notice to the Asst. Public Prosecutor concerned, in such an event, the learned Magistrate shall grant bail to the petitioners on the same day with necessary conditions. Needless to say at the post-bail stage, pending investigation their presence shall be dispensed with before the trial Court. Any remedy is left open in case police filing final report and taking cognizance by the Court. Consequently, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
