HON'BLE SRI JUSTICE S.V.BHATT W.P.No.23650 OF 2011 ORDER:
The writ petition is at the instance of Agri Biotech Manufacturers Association, represented by its President J.Shekhar Reddy. The petitioner prays for the following relief: "......this Hon'ble Court may be pleased to issue appropriate writ, order or direction one more particularly in the nature of "Writ of Mandamus" declaring the action of the respondents in interfering with the business of bio-products by members of the petitioner Association by issuing unwritten, oral instructions to their deputies, officers and subordinates to intimidate and stop the Distributors, Stockists, Retailers and Sellers from stocking or selling bio-products as illegal, arbitrary, unconstitutional and consequently direct the respondents not to interfere with the business of bioproducts by the members of the petitioner and the petitioners to act in accordance with any established procedure of law if they intend to interdict the sale of any bio-products manufacturer for any legitimate reason......"
I am of the view that the prayer in the instant writ petition is general in terms and there is no interim order in favour of petitioners from 2011 till date. The individual manufacturers of Agri Biotech Products if have independent cause of action, they are certainly free to work out their remedies within the four corners of law. Having regard to the nature of writ prayer and passage of time from 2011 till date without there being an interim order in favour of the petitioners, I am of the view that the cause with which the present writ petition is filed may not survive at this point of time. As already noted, if any individual grievance arises for the Agri Biotech Manufacturers, they are free to work out their remedies in properly instituted proceedings.
With the above observations, the writ petition is dismissed. There shall be no order as to costs.
Consequently, pending miscellaneous petitions, if any, also stand disposed of.
