HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 17848 of 2002 ORDER: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.
Sri G. Dasaradharami Reddy, learned counsel for the petitioner, prays for withdrawal of this writ petition with liberty to the petitioner to file appropriate proceedings against the order of conviction, impugned in the present writ petition, in terms of the judgment of the Supreme Court in Transmission Corporation of A.P. vs. Ch. Prabhakar and others[1].
Writ petition is disposed of as withdrawn with liberty as prayed. We observe that if the petitioner takes an appropriate remedy against the order of conviction, it will be open for him to make an application for condonation of delay and we are sure that the said application will be considered in accordance with law and in proper perspective. The order of suspension of sentence passed on 18.09.2002 shall remain operative for a period of four weeks from today.
Miscellaneous petitions, if any, shall also stand disposed of. There shall be no order as to costs.
