THE HON'BLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No.3063 of 2025 ORDER:

This criminal petition is filed by the petitioner/CCL-2 under Sections 480 and 483 of Bharatiya Nagrik Suraksha Sanhita (BNSS) seeking regular bail in Crime No.141 of 2024 on the file of the Station House Officer, Chilkalguda Police Station, Hyderabad, registered for the offences under Sections 302, 396 and 201 read with 34 of the Indian Penal Code, 1860. 2.

Heard Sri P. Vikasraj, learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondent.

The case of the prosecution is that on 07.03.2024 one Ramala Prabhudev has filed a complaint, wherein it is stated that he is the Driver of Mini JCB in the Greater Hyderabad Municipal Corporation and as part of his job, on 07.03.2024 at about 0210 hours when he stopped at open garbage point, Railway Quarters, Hamal Basthi, and get down to clean the premises, he noticed one unknown male person laying on footpath with bleeding injury on his left side of chest and pool on

the ground. Basing on the said complaint, the Inspector of Police registered a case in Crime No.141 of 2024 for the offence punishable under Section 302 IPC.

Learned counsel for the petitioner submits that the petitioner has not committed the offence and he was falsely implicated in the above said crime. He further submits that the petitioner was arrested on 07.03.2024 and the Investigating Officer after conducting the investigation filed charge sheet and the same was numbered as S.C.No.909 of 2024. He further submits that the other accused were already enlarged on bail and the petitioner is a student and he will appear before the concerned Court and cooperate for speedy disposal of the case. Unless the petitioner is enlarged on bail, he will be put to irreparable loss and hardship. He further submits that the petitioner will abide by the conditions that are going to be imposed by this Court.

Per contra, learned Additional Public Prosecutor submits that after conducting investigation, the Investigating Officer filed charge sheet and the same was numbered as S.C.No.909 of 2024 and he has not disputed about granting of bail to other accused.

Having considered the rival submissions made by both the parties and after perusal of the material available on record, it reveals that the Investigating Officer after conducting investigation, filed charge sheet and the same was taken cognizance and numbered as S.C.No.909 of 2024 on the file of the VI Additional Metropolitan Sessions Court, Secunderabad. The petitioner was arrested on 07.03.2024 and since then he is in judicial custody.

Taking into consideration the above said facts as well as granting of bail to other accused, this Court is inclined to grant bail to the petitioner on the following conditions: (1) The petitioner/CCL-2 is enlarged on bail on his executing a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousands only) with two sureties for a like sum each to the satisfaction of X Additional Chief Metropolitan Magistrate, Secunderabad.

(2) The petitioner shall appear before the concerned Court in S.C.No.909 of 2024 on each and every adjournment.

(3) The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of BNSS).

Accordingly, the criminal petition is allowed. Pending miscellaneous applications, if any, shall stand closed.
