This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') seeking grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.1 to 4 in Crime No.8 of 2026 of

Rajampet Police Station, Kamareddy District, registered for the offence punishable under Section 108 of the BNS. 2.

The case of the prosecution is that on 29.01.2026, the de-facto complainant lodged a report before the police stating that he has two daughters and one son. About six years ago, his son married one Roja and they were blessed with two daughters. His son is presently working at Hyderabad for his livelihood. At that time, a villager namely Maloth Prakash became acquainted with his daughter-in-law Roja. On 10.09.2025, when no one was present at the house, Maloth Prakash went to their house and caught hold of Roja's hand. Meanwhile, she shouted loudly, and he threatened her that if she did not talk to him, he would kill all her family members. Later, the matter was discussed before the village elders. Since then, the victim became distressed and committed suicide on 28.01.2026. Hence, the complainant requested the police to take necessary action as per law. Basing on the said complaint, the police registered a case for the above said offence.

Heard Sri Chatla Madhu, learned counsel appearing on behalf of the petitioners, as well as Sri M. Ramachandra

Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the said allegations and that there are no specific allegations against them. It is further submitted that, according to the petitioners, the incident took place on 01.11.2025, whereas the deceased committed suicide on 28.01.2026, and therefore there is no proximity of time to show that the deceased committed suicide due to the alleged abetment by the petitioners. It is also submitted that the petitioners are ready to cooperate with the investigation. Therefore, he prayed that this Court may grant pre-arrest bail to the petitioners by allowing the present criminal petition. 5.

On the other hand, the learned Additional Public Prosecutor opposed the same, stating that the allegations clearly show that the deceased committed suicide due to the abetment of these petitioners. As such, custodial interrogation of the petitioners is required for further investigation, and therefore he requested this Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, the petitioners herein are arrayed as accused Nos.1 to

The allegations against the petitioners are that accused No.1 tried to murder the daughter-in-law of the complainant, who is the wife of the deceased, and also threatened her that if she did not heed his words, he would kill all her family members. The said incident is alleged to have occurred in the month of November, 2025, whereas the deceased committed suicide on 28.01.2026.

Considering the facts and circumstances of the case, the allegations against the petitioners, and the time of the alleged incident, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions:

i) The petitioners shall surrender before the Station House Officer, Rajampet Police Station, Kamareddy District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- each, with two sureties, for the like sum each.

ii) The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii) The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of 8 weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
