THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4652 OF 2016 ORDER:

This petition is filed by the petitioner-Accused No.2 under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.69 of 2016 on the file of Nallakunta Police Station, Hyderabad City, registered for the offence punishable under Sections 406 and 420 IPC.

Heard and perused the material available on record. It is stated in the complaint that A1 promised to secure M.D. (Dermatology) seat at Bhaskara Medical College, Hyderabad in the management quota for the daughter of the 2nd respondent. The 2nd respondent paid Rs.50 lakhs as 1st instalment to the petitioner-A2, who was introduced by A1, and he also paid Rs.35 lakhs through A1 as second instalment. Thereafter, the accused postponed the issue and A1 avoided the 2nd respondent.

Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to grant the relief sought by the petitioner.

Accordingly, the Criminal Petition is dismissed. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. ______________________ JUSTICE RAJA ELANGO Date : 4.4.2016 Nn
