J.V.S.Chowdary v. State Of Telangana
SMT. JUSTI CE T.RAJANI CRI MI NAL PETI TON No. 2 0 1 2 OF 2 0 1 8 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No. 9, in crime No. 16 of 2018 of Chunchupalli Police Station, Bhadradri Kothagudem District. 2.
As per the case of the prosecution, accused Nos. 1 to 8 went and attacked the de facto complainant and they mentioned that they were the henchmen of the petitioner. Learned counsel for the petitioner submits that there is rivalry between the de facto complainant and the petitioner who are running colleges and hence, the petitioner is falsely implicated. Learned Public prosecutor submits that the confession of accused Nos. 1 to 8 revealed that the petitioner himself had engaged the other accused.
3.
Hence, in view of the nature of the allegations, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the Court below having jurisdiction. The Court below shall dispose of the bail application on merits, if any filed, expeditiously, preferably on the same day, subject to pressure of other work.
4.
Subject to the above, the criminal petition is dismissed. Pending miscellaneous petitions, if any, shall stand dismissed in consequence.
