THE HONOURABLE SRI JUSTICE K.LAKSHMAN CRIMINAL PETITION Nos.1701 & 1730 OF 2022 COMMON ORDER:

These Criminal Petitions under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), are filed seeking to quash the proceedings in C.C.No.485 of 2015, pending on the file of Judicial First Class Magistrate at Ramannapet. The petitioners herein are accused Nos.1 to 5 in the said crime. The offences alleged against them are under Sections 427 and 323 read with 34 of IPC.

Heard the learned counsel for the petitioners and the learned Public Prosecutor and perused the record. 3.

In the charge sheet, prima facie, there are specific allegations against all the petitioners herein including accused No.5. The grounds raised by the petitioners herein are triable issues. This Court cannot consider the said issues in an application filed under Section 482 Cr.P.C. Petitioners have to face the trial and prove their innocence. Therefore, this Court is not inclined to quash the proceedings in C.C.No.485 of 2015. 4.

In view of the above, these Criminal Petitions are liable to be dismissed and accordingly, they are dismissed. Since the Calendar Case is of the year, 2015, the learned Judicial First

Class Magistrate, Ramannapet is directed to dispose of the said CC in accordance with law, as expeditiously as possible preferably within three (03) months from the date of receipt of a copy of this order. No order as to costs.

5. Miscellaneous Petitions, if any, pending, shall also stand closed.
