This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.5 in Crime No.1134 of 2025 of Chandanagar Police Station, Cyberabad Commissionerate. The offences alleged against the petitioner are punishable under Sections 8 (c) r/w. 20 (b) (ii) (C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act').

The facts of the case are that on 07.10.2025, on reliable information, the police reached Lingampally Railway Station at about 09:30 hours and noticed some suspected persons in the waiting hall with seven bags, moving in a suspicious manner while waiting for a train to Mumbai. When the police approached them, the suspects attempted to escape but were apprehended. On questioning, they confessed that the bags contained Ganja packets. The police opened the bags and found several packets wrapped in brown tape. On further inspection, the packets contained flowering and fruiting tops with a pungent smell, which were identified as Ganja, weighing about 47.1 kilograms. Hence, a case was registered against the accused for the said offences.

Heard Sri P.Vikasraj, learned counsel appearing on behalf of the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

The contention of learned counsel for the petitioner is that petitioner is in judicial custody from 07.10.2025 and investigation in sofar as the petitioner is concerned, is substantially complete and no further custodial interrogation is required. The petitioner was implicated in this case basing on

the confession statement of co-accused and no independent material is placed to establish conscious possession. Hence, prayed this Court to grant bail to the petitioner. 5.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the quantity involved is a huge commercial quantity of 47.1 kgs of Ganja and investigation is still under progress. The petitioner along with other accused was found in possession of contraband and investigation is not yet completed. Hence, in view of rigor of Section 37 of NDPS Act, petitioners are not entitled for bail.

Upon consideration of the rival submissions and perusal of the material available on record, this Court is of the view that the petitioner has been in judicial custody since 07.10.2025. The investigation, insofar as the petitioner is concerned, appears to be substantially completed and no further custodial interrogation is warranted. Though the contraband seized is of commercial quantity attracting the rigour of Section 37 of the NDPS Act, having regard to the period of incarceration already undergone and the stage of investigation, this Court is satisfied that the petitioner is entitled to be enlarged on bail, subject to conditions to ensure his availability for investigation and trial.

Accordingly, the petitioner is directed to be released on bail on the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only, with two sureties for a like sum each to the satisfaction of the I Additional District and Sessions Judge, Ranga Reddy District, at LB.Nagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
