THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.41902 of 2015 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated above, it is therefore, prayed that this Hon'ble Court may be pleased to issue a Writ or Order, more particularly in the nature of "Writ of Mandamus" A. To declare the proceedings Rc.No.446/B/TE/SCERT/2015-2 dated 08.12.201,5 issued by the 3rd Respondent rejecting the renewal affiliation of the Petitioner College for the academic year 2015-16, and consequent action of the 1st & 2nd Respondents in failing to include the Petitioner College in the list of colleges notified for web-counseling of DEECET 2015 of 2 Year course of D.EL.ED 2015-16 as per the notification published as being without jurisdiction, illegal, arbitrary and unconstitutional and in violation of Art. 14, 19(1) (g) and 21 of the Constitution of India.

B. To direct the Respondents to grant renewal affiliation for the period of 2014-18 as per the application dated 07.06.2014 submitted by the Petitioner College, and C. Pass such other further order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." It appears that the case of the petitioner was again reconsidered for grant of affiliation for D.El.Ed. Course for the year 2015-16 after the institution of the writ petition.

The Commissioner of School Education, Andhra Pradesh, Hyderabad, addressed letter dated 27.01.2016 to the Secretary to Government, School Education, Government of Andhra Pradesh, in relation to consideration of three Colleges, one of which was the petitioner - College.

Having set out the relevant details, the Commissioner requested the Government to issue suitable orders in the matter.

Sri N.Ashwani Kumar, learned counsel for the petitioner - College, would submit that pursuant to the afore-stated proposal of the Commissioner of School Education, the other two colleges mentioned in the letter dated 27.01.2016 were granted affiliation but the case of the petitioner - College alone was kept aside owing to the pendency of this writ petition.

In the light of the fact that the Commissioner of School Education, Andhra Pradesh, has already submitted a proposal to the State Government in relation to the petitioner - College also and as other similarly situated Colleges have already been granted relief, this writ petition is disposed of directing the first respondent to forthwith consider the case of the petitioner pursuant to the proposal submitted by the Commissioner of School Education under letter dated 27.01.2016 and take an appropriate decision thereon in accordance with law expeditiously and in any event, not later than three weeks from the date of receipt of a copy of this order.
