Learned counsel for the appellant does not press this appeal and submits that the appellant would be satisfied if an observation is made that allotment of shop No.1 in favour of respondent No.4 and handing over possession in pursuance of the allotment and execution of lease agreement would be subject to outcome of the writ petition. Learned counsel for respondent No.4 has no objection for making such observation.

We therefore dispose of this appeal as not pressed and observe that allotment and putting respondent No.4 in possession of shop No.1 and execution of lease agreement shall be subject to outcome of the writ petition. We request learned Single Judge to hear and decide the writ petition expeditiously.
