O R D E R

The case of the petitioner is that the unofficial respondent No.6, illegally sold the marriage/function hall allotted to Punjabi community in Sy.No.192 of Alwal Grampanchayat, to one C.B.Ravi. Aggrieved by the said illegal sale, he filed complaint on 6.6.2015 to the 4th respondent - Inspector of Police, Alwal Police Station, Alwal, Secunderabad, and subsequently he made representation dated 1.7.2017 to respondents 2 and 3 for taking action with regard to his complaint filed on 6.6.2015. Alleging that the official respondents have not taken any action on his complaint, the present writ petition is filed. The 4th respondent filed counter affidavit, wherein it is stated as under: "3. It is respectfully submitted that as per the writ averments, the petitioner contended that he sent complaint dated 6.6.2015 through registered post on 24.06.

2015 to the respondent No.4 Inspector of Police, Alwal Police Station, Cyberabad with regard to said Punjabi Community Hall. In this connection it is submitted that after communication of the writ petition, the respondent No.4 verified the station records, whether they received the alleged complaint of the petitioner or not and the records revealed that, as of now, no complaint was received.

4. It is further respectfully submitted that whenever, the petitioner approaches the respondent No.4 along with complaint, necessary action will be taken as per law.

It is further respectfully submitted that as per the writ averments, there is a civil dispute between the petitioner and the respondent No.6 Jagan Mohan Shahani with regard to marriage/function hall, under Sy.No.192, admeasuring 200 sq. yards, situated at Alwal Village, for which the respondent No.4 has nothing to do. The petitioner is unnecessarily involving the police into civil litigation.

7. It is vital to submit here that the petitioner alleged that he sent the alleged complaint through post in the year 2015 and after keeping quiet for last four years, filed the present writ petition."

Petitioner has not filed any reply affidavit contraverting the averments made in the counter affidavit.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

In view of the above statement made in the counter affidavit, the relief sought for by the petitioner cannot be granted and the writ petition is accordingly dismissed.

Interlocutory applications pending, if any, shall stand closed. No order as to costs.
