HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6745 of 2019 ORDER:
The prayer of the petitioner in this case reads as under:- For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of respondent No.2 in not including the lands in Sy. No.17 in an extent of Acs.16.08 gts in the name of the petitioner in the record of rights and issuance of the Pattadar Pass Books and title deed Book accordingly in spite of representation dated 01.11.2018 and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case." Perusal of the record reflects that Form I-B dated 21.01.2018 was issued by the revenue authorities indicating that the land admeasuring Acs.16.
08 guntas in Survey No.17 of Porandla Village, Maheswaram Mandal, Ranga Reddy District, was also included in the petitioner's land holdings. His grievance presently is that the new pattadar pass book issued to him as per the Government's policy does not include this land due to some reason. His representation in this regard was received by the Tahsildar, Maheswaram Mandal, Ranga Reddy District, but no action seems to have been taken thereon.
It is not open to the Tahsildar concerned to remain somnolent having received such a representation as valuable property rights of the petitioner would be at stake in the event any of his land holdings are excluded from his new pattadar pass book. The Writ Petition is accordingly disposed of directing the Tahsildar, Maheswaram Mandal, Ranga Reddy District, to take
SK, J WP.No.6745 of 2019 Dt:01.4.2019 appropriate action upon the petitioner's representation dated 01.11.2018 on its own merits and in accordance with the due procedure expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
