THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.10891 of 2016 ORDER:
The criminal petition is filed against the order dated 07.06.2016 in Crl.R.P.No.21/2016 on the file of the Principal Sessions Judge, Kurnool, by and under which, the Court below allowed the revision in part, slightly modifying the order of the trial Court. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor, representing the State. The petitioner filed Crl.MP.No.1416/2016 in Cr.No.21 of 2016 of Krishnagiri P.S. under section 457 Cr.P.C on the file of the Judicial Magistrate of First Class, Dhone, seeking interim custody of the seized Tractor and Trolley bearing No.AP21-T4525. The trial Court, vide orders dated 04.04.2016, allowed the said petition subject to petitioner furnishing fixed deposit of Rs.
7,00,000/- for a period of two years in any Nationalized Bank and further she shall execute a personal bond for the said amount with one surety in a like sum. In addition, the trial court further imposed usual conditions for release of the vehicle. Aggrieved by the direction of furnishing fixed deposit of Rs.7,00,000/-, the petitioner filed Crl.R.P.No.21 of 2016 before the court below, and the learned Sessions Judge, by order dated 07.06.2016, allowed the revision in part by reducing the fixed deposit from 7,00,000/- to 3,50,000/- while maintaining the other conditions as imposed by the trial Court. Against the said order, the present criminal petition is filed.
Having heard the learned counsel on either side and having perused the material on record, the Criminal Petition is disposed of, by modifying the orders of the Court below to the effect that the petitioner shall furnish Bank Guarantee for a sum of Rs.1,75,000/- (Rupees one lakh seventy five thousand only) together with a personal bond in a
like sum. The rest of the conditions as imposed by both the Courts below shall stand maintained.
Pending miscellaneous applications, if any, shall stand closed in consequence.
