When the case is taken up for hearing, it is submitted by the learned counsel for the petitioner that the present writ petition was filed challenging the inaction of the respondents in not settling the pensionary benefits, consequent upon the retirement of the petitioner. However, by virtue of the interim order by this Court on 28.01.2008, the pensionary benefits are settled and in view of the same, he does not want to prosecute the case further.
