HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN CIVIL REVISION PETITION No. 710 of 2017 ORDER:

The petitioners have come up with the present revision, challenging an order of the Estates Abolition Tribunal granting a stay of the patta granted in their favour, pending disposal of a regular appeal.

Heard Mr. Kowturu Pavan Kumar, learned counsel for the petitioners, and Mr. K. Ranga Rao, learned counsel for the respondents 1 to 3, 5, 7, 9, 12 to 15, 17, 21 to 24 and 26. 3.

The appeal pending before the Estates Abolition Tribunal arises out of the order passed by the Joint Collector under the provisions of the Andhra Pradesh (Andhra Area) Estates (Abolition and Conversion into Ryotwari) Act, 1948. Since it is a regular appeal, the learned Presiding Officer of the Tribunal thought fit to grant stay of the patta. 4.

The concern of the learned Presiding Officer that if stay is not granted, the statutory remedy of appeal may become illusory, cannot be completely rejected as baseless. Therefore, in such a case, it will be better to have the appeal itself disposed of within a timeframe. 5.

Hence, the Civil Revision Petition is disposed of, while confirming the order of the Tribunal, directing the Tribunal to dispose of the appeal, within a period of eight (8) weeks from the date of receipt of a copy of this order.
