Ch.Srinivas Reddy v. The State Of Telangana
HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.6746 of 2019 ORDER:
The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of Mandamus declaring the inaction of Respondent No 3 in mutating the name of the petitioner in Revenue Records and in not issuing Pattadar Passbooks and Title Deeds to the petitioner as illegal arbitrary and against the principles of natural justice and consequently direct the Respondent No 3 to mutate the name of the petitioner and to issue Pattadar Passbooks and Title Deeds and pass such other relief or reliefs as this Honble Court deems fit and proper in the circumstances of the case." Perusal of the record reflects that the petitioner submitted an application in the prescribed format in Form VI (A) as required under the Telangana Rights in Land and Pattadar Pass Books Act, 1971, along with the requisite fee for seeking mutation.
Having received such an application, it is not open to the Tahsildar concerned to remain somnolent.
The Writ Petition is accordingly disposed of directing the Tahsildar, Chilpur Mandal, Janagaon District, to take appropriate action upon the petitioner's Form VI (A) application as per the due procedure expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
Miscellaneous Petitions pending in this Writ Petition shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR 1st April, 2019.
