THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO. 34192 OF 2013 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for respondent Nos. 1 to 3. 2.

The prayer sought in the Writ Petition is as under: " ...to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of respondents in seizing the JCB bearing No. AP 35 G 7870, Engine No. 4H22510702302 of the Petitioner and registered crime in FIR No. 229/2013 dt. 21-11-2013 without following any procedure under statutes contemplated Under Section 9 Q Sub section 7 of The AP Minor Mineral Concession Rules, 1966, as illegal, arbitrary, high handness and against to the principles of natural justice and violative of Article 14, 16, 19 (1) (g), 21, 300 A and 301 of the Constitution of India and consequently direct the respondents to release the subject JCB from their custody to the petitioner."

During the course of arguments, learned Government Pleader placed on record, the endorsement dated 22.4.2014 executed by the petitioner to the effect that the JCB bearing No AP 35 G 7870 Engine No. 4H22510702302, seized in Cr.No.229 of 2013 on 21.11.2013 has been released to him.

Having regard to the said fact, no further cause would survive in the Writ Petition.

Accordingly, the Writ Petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
