The rejection of petitioner's building permission application through the impugned Shortfall Intimation Letter dated 25.03.2019 is challenged before this Court. By the impugned letter, petitioner was directed to resubmit his application showing the affected road portion of 100 feet, which is proposed to be widened to 150 feet as per new Draft Master Plan. 2.

At the hearing, learned counsel for both sides submit that the subject matter is covered by the order dated 01.02.2019 in W.P.Nos.1573 and 1586 of 2019 and hence similar orders may be passed in this writ petition.

In view of the orders dated 01.02.2019 in W.P.Nos.1573 and 1586 of 2019, and for the reasons alike, the present writ petition is allowed setting aside the impugned Shortfall Intimation Letter dated 25.03.2019. Within four weeks from the date on which the petitioner resubmits his application for building permission, respondents 2 and 3 shall consider the same in accordance with law, including the provisions of the Greater Hyderabad Municipal Corporation Act, 1955, the Rules and Bylaws made thereunder, take a decision thereupon, and communicate the same to the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any pending, shall stand closed.
