HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION Nos.9337 and 9355 of 2015 COMMON ORDER :
The petitioners/A1 to A7 respectively in both the criminal petitions are self same persons who are accused in Crime Nos.57 and 59 of 2015 of Women Police Station, Kadapa, Kadapa District, which is out come of their reports respectively. The second respondents/defacto complainants in both the cases are no other than own sisters and the crimes registered for the offences punishable under Sections 498-A, 323, 506 of IPC and Sections 3 and 4 of Dowry Prohibition Act. One crime is registered on 27.08.2015 and the other on 31.08.2015 respectively with similar allegations of harassment, dowry demand, beating and criminal intimidation.
Heard learned counsel for the petitioners and the first respondent-State before the admission and before notice to the second respondents/def ac t o complainants respectively and perused the material on record.
As the material on record falls short for this Court to admit the Criminal Petitions filed under Section 482 Cr.P.C to quash the FIR proceedings but for to the entitlement of concession of regular bail, the Criminal Petitions are disposed of giving liberty to petitioners to surrender before the learned Magistrate concerned and move for regular bail with notice to additional public prosecutor concerned and in such event, the learned Magistrate shall grant bail with necessary conditions on the same day. Needless to say, at post bail stage, pending investigation their presence before the Court concerned can be dispensed with.
Further remedies are left open to them, in the event of police filing final report and after taking cognizance by the learned Magistrate. Consequently, the miscellaneous petitions, if any pending, shall stand closed.
