Learned counsel for the appellant submitted that in view of the decision of the Apex Court in Managing Director, KSRTC v New India Assurance Co. Ltd and another1, the cause in the appeal does not survive for adjudication.

Recording the above submission, MACMA is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this appeal shall stand closed.
