THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION Nos.7694 & 25332 OF 2013 COMMON ORDER:

W.P.No.7694 of 2013 is filed by one A. Kumaraswamy alleging that even though directions were issued to B. Mogilaiah, the unofficial respondent therein, who is petitioner in W.P.No.25332 of 2013 to remove the unauthorized construction, he is not removing the same and no action has been taken by the respondent - Municipal Corporation.

During the pendency of the said Writ Petition, Mogilaiah filed W.P.No.25332 of 2013 challenging the notice dated 26.08.2013.

In W.P.No.25332 of 2013, this Court by order dated 28.08.2013 directed the respondent - Corporation not to effect demolition. Petitioner was also directed not to make construction. 4.

During the pendency of these two Writ Petitions, Mogilaiah applied for regularization of the unauthorized construction made. 5.

Learned standing counsel for the respondent - Municipal Corporation informs the Court that the said application is pending.

Having regard to the same, these two Writ Petitions are disposed of directing the respondent - Municipal Corporation to consider the building regularization application and till such application is considered and appropriate orders are passed, the Municipal Corporation is directed not to take any coercive action

against the petitioners. Further, petitioners shall not make any further construction. Pending miscellaneous petitions shall stand closed.
